Drunk Driver Causes Major Wreck

Pike v. Duda -- Settled Prior to Litigation [Merced County / November 2014] Elderly client was injured when a neighbor's German Shepherd jumped on client and knocked her off a curb. FHV successfully settled the case for $270,000 prior to serving a complaint.

FHV represented a driving instructor who was teaching a driving lesson when his vehicle was rear-ended at a stop light. The insurance company argued it was a low-impact collision and no injuries resulted from the wreck. FHV proved that the driving instructor’s shoulder, neck and low back injuries were related to the collision.

The case settled prior to trial for $175,000.

Driver High on Meth Causes Fatal Crash

Hernandez v. Markos

FHV represented an injured passenger of a vehicle involved in a drunk driving crash. FHV filed a claim against the defendant drunk driver was quickly able to settle the case for the maximum policy limits of $100,000, without filing a lawsuit or going to Court.

Lees v. Dhah

FHV’s client was involved in a low-impact rear-end collision in Fresno, California. Although the impact was low and caused less than $700 of property damage, FHV’s client had a previous injury that made her susceptible to hip injury. The minimal force of the impact resulted in FHV’s client sustaining a fracture of her femoral neck approximately 4 days following the collision. FHV was able to tie the femoral fracture into the vehicle collision and resolve the case with the defendant driver’s insurance company for the policy limits of $100,000.

Moultrie v. Rodriguez

FHV’s client was injured when the defendant backed her car into our client’s vehicle in a parking lot. FHV resolved the case with the defendant driver’s insurance company for the policy limits of $100,000.

Elderly Woman is Rear-Ended on Freeway

FHV represented an elderly woman who was injured when an uninsured motorist caused a collision on Highway 41. Thankfully, FHV’s client had uninsured motorist coverage and FHV was able to quickly resolve the case for the policy limits of $100,000.

Jenkins v. City of Fresno

FHV represented a teenager who was injured while practicing football in a park owned and managed by the City of Fresno. While running during football practice, FHV’s client tripped and fell forward, hitting his mouth on a metal bracket protruding from the ground. FHV filed a premises liability lawsuit in Fresno County Superior Court seeking compensation for the teenager’s medical and dental bills, as well as for the teenagers' pain and suffering. At the outset of the case, the City of Fresno denied any liability. Following depositions and discovery, however, the City of Fresno eventually agreed to resolve the case for $70,000.

Medina v. Medina -- Settled Prior to Trial [Merced County Superior Court / December 2014] Client fell off a ladder at brother's house and sustained serious injuries to his ankle. FHV successfully resolved the case for $50,000 against the brother's homeowner's insurance company prior to trial.

FHV’s client was involved in a vehicle collision caused by an uninsured drunk driver. Because our client had uninsured motorist coverage in place at the time of the collision, we were able to resolve the case for the policy limits of $50,000.

On the first day of trial, the City of Clovis paid our client $45,000 for injuries she suffered in a fall as a result of a defective sidewalk. Our client sustained approximately $19,000 in medical costs. Prior to trial, the City of Clovis was offering nothing.

Fernandez v. Union Pacific Railroad, et al.

FHV represented the father of a young man killed in a train v. vehicle collision. After litigating the case for over 2 years, and on the eve of trial, FHV successfully resolved the case for a substantial (confidential) settlement amount.

FHV files suit against the Fresno Unified School District after a special-education teacher strikes a deaf 13 year-old student in the face with a binder. FHV is seeking damages for negligence, assault, battery and intentional infliction of emotional distress.

Foursha v. Merced County Rescue Mission

FHV files suit against the Merced County Rescue Mission for negligent hiring and retention of an unfit employee. Our client, a homeless woman, would often turn to the rescue mission for shelter, showers, clothing and essential food. On multiple occasions, our client was required to endure unwanted groping, sexual harassment, and sexual requests from employees of the Merced Rescue Mission in order to be provided food and clothing. And when our client refused these sexual advances, she was banned from the rescue mission until she was hungry and desperate enough to return and submit to the employee's sexual demands. FHV is seeking general, special and punitive damages in the lawsuit.

FHV retained by a Fresno woman who suffered a fractured vertebra in a low impact vehicle collision. FHV will be pursuing a negligence claim against the at-fault driver, and will likely be pursuing an underinsured motorist claim against our client's car insurance carrier.

Gharibian v. Doe -- Settled for Policy Limits [Kings County Superior Court / February 2015] Minor child suffered massive internal injuries when uninsured motorist ran a red light and collided with client's vehicle on Highway 41 in Hanford, California. FHV obtained a policy limits payout from client's uninsured motorist insurance carrier, Amerprise Insurance.

Hearden v. Watson -- Settled Prior to Trial [Fresno County Superior Court / March 2015] Client struck by Defendant's vehicle while walking in crosswalk at Cedar Avenue and Shepherd Avenue in Fresno, California. Client sustained a skull fracture and fractures to both ankles. FHV obtained a policy limits payout from Defendant driver's insurance carrier, State Farm Insurance, within 2 months of being retained by the client.

FHV retained by victims of a central Fresno house fire to pursue wrongful death and premises liability claims against the property owner who removed the smoke detectors from the house before to the fire.

John Doe v. Kaiser Foundation Hospitals, et al. (2014) - Settled prior to Arbitration. FHV sued a hospital and medical provider for medical malpractice related to minor surgery. Plaintiff was paid a confidential five-figure settlement.

FHV retained by an 87-year-old man who had his thumb chewed off by a pitbull that escaped from his neighbor's yard. FHV will be pursuing claims against the dog owner and property owner for negligence and premises liability.

FHV retained by the family of a mentally disabled 13-year old who was physically assaulted by school staff in Stockton, California. FHV will be pursuing intentional tort claims against Point Quest Education, Inc. for physical and emotional injuries sustained by the minor child.
